Terms of Service

Welcome to ShoreTalents ("ShoreTalents," "we," "us," or "our"), the Caribbean's premier jobs and talent platform. By accessing or using our website, mobile applications, and services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Platform.

1. Eligibility & Accounts

You must be at least 18 years old to create an account and use the Platform. By registering, you warrant that:

• All information provided during registration is accurate and complete.
• You will maintain the security of your account credentials and promptly notify us of any unauthorized use.
• You are legally permitted to work or hire in the jurisdictions relevant to your use of the Platform.

ShoreTalents reserves the right to suspend or terminate accounts that violate these Terms or our policies.

2. User Roles

The Platform supports several user roles:

• Job Seekers may browse jobs, create profiles, apply to postings, join the talent pool, and offer services.
• Employers may post jobs, search candidates, post talent requests, and hire through the Platform.
• Recruiters & Agencies may post jobs on behalf of client companies, subject to the same obligations as employers.
• Service Providers (Freelancers) may list services, receive orders, and transact with clients through the services marketplace.
• Event Organizers may post job fairs, webinars, and networking events for moderation and publication.

3. Job Postings & Applications

Employers and recruiters are responsible for the accuracy, legality, and completeness of all job postings. You agree that:

• Job postings must comply with all applicable employment and anti-discrimination laws in the relevant Caribbean jurisdiction.
• Salary and wage information, where provided, is tracked by ShoreTalents to build market-rate transparency data. Employers consent to this aggregation.
• When a job links to an external application URL, the primary application method is the company's own careers page. ShoreTalents provides an in-platform application option as a convenience, but does not guarantee that in-platform applications will be reviewed by the employer.
• ShoreTalents reserves the right to moderate, reject, or remove any job posting that violates our guidelines or applicable law.
• Job seekers are responsible for the accuracy of their applications, resumes, and profile information. Misrepresentation of qualifications may result in account suspension.

4. Services Marketplace

The Services Marketplace operates as a two-way platform similar to Fiverr, where freelancers offer services ("Gigs") and clients post job requests. By using the marketplace you agree that:

• Service Listings: Sellers must accurately describe their services, pricing, delivery timelines, and packages. Price tiers (packages) must clearly state what is included.
• Job Requests: Buyers posting requests must provide accurate budgets, scopes, and timelines. All requests are moderated before going live.
• Platform Fee: ShoreTalents charges a platform fee (default 10%) on completed transactions. This fee is deducted from the seller's payout.
• Escrow & Milestones: Payments may be held in escrow and released upon milestone completion or delivery approval. Funds held in escrow are not refundable to the buyer once released to the seller for completed work.
• Disputes: If a dispute arises, either party may contact ShoreTalents support. We will review the milestone submissions, communications, and delivery evidence to mediate. Our decision on escrow release is final.
• Off-Platform Transactions: To protect both parties and maintain quality guarantees, users are strongly discouraged from processing payments outside the Platform. ShoreTalents cannot assist with disputes for off-platform transactions.
• Portfolio Images: All images uploaded to service galleries are watermarked with the ShoreTalents brand to protect seller intellectual property.

5. Talent Pool & Candidate Search

Job seekers may opt into the Talent Pool to be discoverable by employers. Employers with active subscriptions may search and contact candidates. You agree that:

• Job seekers control their visibility settings and may opt out of the Talent Pool at any time.
• Employers are subject to daily contact unlock limits based on their subscription tier. Exceeding these limits is prohibited.
• Contact information (phone, email, references) is gated and only visible to the profile owner and authorized employers after an unlock is consumed.
• Employers may not use candidate data for purposes other than legitimate hiring. Mass harvesting or reselling of candidate data is strictly prohibited.

6. Remote Sourcing & Custom Requests

Clients may submit remote sourcing requests for ShoreTalents to match Caribbean talent to international roles, and custom requests for partnerships or specialized hiring. ShoreTalents acts as an intermediary and does not guarantee placement. All matched candidates are vetted but clients are responsible for final hiring decisions and compliance with immigration and labor laws in the destination country.

7. Events & Job Fairs

Organizers may post events including job fairs, webinars, workshops, and networking sessions. You agree that:

• All events are subject to moderation before publication. ShoreTalents reserves the right to reject or remove events.
• Organizers are responsible for the accuracy of event details, including dates, times, venues, and registration links.
• Virtual room links are private and shared only with attendees who have registered interest. Sharing these links publicly is prohibited.
• Networking features allow attendees to see who else is interested. Organizers control whether this feature is enabled.
• ShoreTalents is not liable for cancellations, schedule changes, or the content of third-party events.

8. Referral Program

ShoreTalents operates a referral program that rewards users for inviting new members. You agree that:

• Referral rewards are earned only when a referred user completes a qualifying action (sign-up, hire, subscription purchase, or service order completion).
• Self-referrals or creating multiple accounts to earn rewards is strictly prohibited and will result in forfeiture of rewards and account suspension.
• Reward amounts and qualifying actions may change at ShoreTalents' discretion. Earned rewards will be honored at the rate in effect at the time of the qualifying action.
• Rewards are paid out via the method chosen by ShoreTalents and may be subject to verification and processing time.

9. Subscriptions & Payments

Employers may purchase subscription plans for job posting slots, candidate search access, and featured listings. You agree that:

• Subscription fees are billed in advance on a recurring basis unless cancelled.
• Featured job credits are consumed at the time of purchase and are non-refundable once used.
• Unused job posting slots expire at the end of the billing cycle and do not roll over.
• All payments are processed through our third-party payment provider (Stripe). ShoreTalents does not store card details.
• You may cancel your subscription at any time; access continues until the end of the current billing period.

10. User Content

You retain ownership of content you submit to the Platform, including profiles, resumes, job postings, service listings, event details, and messages. By posting content, you grant ShoreTalents a worldwide, non-exclusive, royalty-free license to display, reproduce, and distribute that content within the Platform for the purpose of operating the service. You represent that you have all necessary rights to the content you submit and that it does not infringe any third-party rights.

11. Prohibited Activities

You may not:

• Post fraudulent, misleading, or discriminatory job listings, service listings, or events.
• Misrepresent qualifications, identity, employment authorization, or company affiliation.
• Harass, threaten, or discriminate against other users.
• Attempt to circumvent platform fees by processing payments off-platform after initial contact through ShoreTalents.
• Scrape, harvest, or mass-download data from the Platform.
• Upload malware, viruses, or malicious code.
• Use the Platform for any illegal activity under the laws of your jurisdiction.

12. Privacy & Data

Your use of the Platform is also governed by our Privacy Policy. ShoreTalents collects and processes personal data to provide our services, including matching, analytics, and communication. Salary and wage data submitted through job postings and company reviews is aggregated to build market transparency tools. Contact information is gated and only shared with authorized parties. You may request deletion of your data at any time through account settings.

13. Intellectual Property

The ShoreTalents name, logo, brand, and Platform software are the intellectual property of ShoreTalents. You may not use our branding without prior written consent. User-generated content remains the property of its creator, subject to the license granted above.

14. Disclaimers & Limitation of Liability

The Platform is provided "as is" and "as available." ShoreTalents:

• Does not guarantee employment, hiring results, or service order completion.
• Is not a party to any employment relationship, service contract, or event arrangement formed through the Platform.
• Is not liable for the conduct, accuracy, or quality of any user's content or services.
• Shall not be liable for indirect, incidental, or consequential damages arising from your use of the Platform.
• Our total liability for any claim arising from the Platform is limited to the amount you paid us in the preceding 12 months.

15. Termination

You may delete your account at any time through settings. ShoreTalents may suspend or terminate your access for violations of these Terms, fraudulent activity, or at our discretion to protect the Platform community. Upon termination, your data will be removed in accordance with our Privacy Policy.

16. Governing Law

These Terms are governed by the laws of Jamaica. Any disputes shall be resolved in the courts of Jamaica, without regard to conflict of law principles.

17. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the Platform or by email. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
